In What Circumstances Should An Application Be Made?
An application for a Direction of the Public Trustee or for the appointment of a receiver should be made when a person:
- is mentally incapable;
- has not made an Enduring Power of Attorney and is mentally incapable of doing so; and
- has assets which need to be used or dealt with for the person's benefit or otherwise administered (such as a property to be sold).
